Jack Lew, John Galt, and American universities

Instead of complaining narrowly about newly confirmed Treasury Secretary Jack Lew?s bloated compensation at NYU, we should demand that all universities release all employee salaries. As tuitions skyrocket, students and parents have the right to know where their dollars are going.

I?ve got one kid in college and another on the way there, so the question is very much on my mind. I also teach at a hugely expensive university, which paid one of its executive vice-presidents more than $800,000 a year and loaned him at least $1.4 million to buy a home. He also received a $685,000 severance payment, and his loan was ultimately forgiven.

I speak of Jack Lew, President Obama?s nominee to lead the Treasury Department. I didn?t meet Lew when he worked at New York University, from 2002 to 2006. But I haven?t met most of the administrators atop our massive institution, which continues to hire more and more of them.

And that?s the real story in the controversy over Mr. Lew, who was confirmed by the Senate as President Obama's new Treasury secretary late yesterday. Most media reports have focused on Lew?s efforts to steer NYU student borrowers towards ?preferred lenders? like Citigroup, which made Lew a top executive after he left NYU. In fairness to Lew, though, we really don?t know if there was any quid pro quo there.

Here?s what we do know: between 1975 and 2005, the number of ?executive, administrative, and managerial employees? at American universities grew by 85 percent. Meanwhile, so-called ?professional staff? ? accountants, counselors, admission officers and so on ? rose by a whopping 240 percent.

But the number of professors grew by just 51 percent ? almost exactly the same rate as student enrollment. In 1975, colleges and universities employed one professor for every 16 students; 40 years later, there was one professor for every 15.

But the administrator-to-student ratios changed dramatically. In 1975, universities hired one administrator for every 84 students and one staffer for every 50 students. By 2005, there was an administrator for every 68 students and a staffer for every 21.

Here?s another way to look at it: Back in 1975, there were about 447,000 professors and 269,000 staffers and administrators. Four decades later, the staffers and administrators outnumbered the professors, 756,000 to 676,000.

And at the top of these pyramids, people pull down huge salaries and perks. By 2007, 12 university presidents earned more than a $1 million salary per year and 81 received more than $500,000. Less well-known are the packages showered on the presidents? every-growing coterie of so-called ?cabinet? hires.

By 2003, for example, the University of Maryland at College Park employed six vice presidents, six associate vice-presidents, five assistant vice-presidents, six assistants to the president, and six assistants to the vice president. And the vice presidents? salaries climbed 50 percent between 1998 and 2003, when student tuition rose sharply as well.

Audrey Hepburn resurrected for chocolate ad

A pretty woman sits on a bus and waits for her journey to continue. She peers into her purse, eyes a bar of chocolate. Outside, a handsome man gives her a smile -- and next thing you know, she's bounding out of the bus and jumping into the stranger's car. And, of course, having a bite of that chocolate bar, all while "Moon River" plays in the background.

The pretty woman? The Oscar-winning actress and humanitarian Audrey Hepburn, who died in 1993. The scene? It may look like a lost sequence from the gamine actress' breakthrough role in 1953's "Roman Holiday" (colorized, natch), but it's actually a combination of footage shot on the Amalfi Coast in Italy (says the Toronto Sun) and a CGI resurrection of the actress -- who happened to sing "Moon River" in 1961's "Breakfast at Tiffany's."

The purpose? To sell the British chocolate bar Galaxy. But not everyone finds the pairing sweet -- critics say the ad is disrespectful to the actress, now dead for 20 years, who can't complain that her image is being ill-used. But Hepburn isn't the first famous face to come back from the dead to shill for a product -- a young Fred Astaire was used in 1997 to push the Dirt Devil vacuum, a deal authorized by his widow but dissed by his daughter, who said she was "saddened that after his wonderful career he was sold to the devil."

In Hepburn's case, she can't stand up for herself to either support or discredit the move, which means it's up to her estate to make these decisions. And her sons, who control that estate, are all for it: Sean Ferrer and Luca Dotti issued a statement saying Hepburn would be "proud" of her latest role, noting that she "often spoke about her love of chocolate and how it lifted her spirit."

They probably didn't mean that last bit literally.

Stocks surge, Dow nears record high

NEW YORK (AP) ? The Dow came within 100 points of its all-time high Wednesday after rising sharply for a second straight day.

The market surged following more evidence that the Fed will keep interest rates low, housing will keep recovering and shoppers aren't pulling back on spending, even with a payroll tax hike.

The gains were broad: Twenty-nine of 30 stocks in the Dow Jones industrial average rose. All 10 industries in the Standard and Poor's 500 index climbed.

The Dow Jones industrial average rose 175.24 points, or 1.2 percent, to 14,075.37. The index is now less than 100 points away from its record close of 14,164 reached in October 2007.

The Dow has surged 290 points in the past two days, erasing its drop of 216 points Monday when inconclusive results from an election in Italy renewed worries that Europe's fiscal crisis could flare up again.

"The market psychology has clearly shifted. It's no longer sell the rally, it's buy the dips," said Dan Veru, chief investment officer of Palisade Capital Management. "The economic data continues to be strong."

Stocks have surged since the start of the year. The Dow is up 7.4 percent.

Earnings for S&P 500 companies will climb 7.8 percent in the fourth quarter, the third straight quarter of growth, according to data from S&P Capital IQ.

The Standard and Poor's 500 index gained 19.05 points, or 1.3 percent, to 1,515.99. The Nasdaq composite rose 32.61 points, or 1.3 percent, to 3,162.26. The index is 6.5 percent higher for the year, and is about 3.1 percent short of its record close of 1,565.

Investors were also encouraged Wednesday that Federal Reserve Chairman Ben Bernanke stood behind the central bank's low-interest-rate policies as he faced lawmakers for a second day. His comments dissipated worries about the bank's resolve to keep up the program. Those worries sprung up last week when minutes from the bank's last policy meeting revealed disagreement among Fed officials.

Also, the number of Americans who signed contracts to buy homes rose in January from December to the highest level in almost three years. The report continued a string of positive housing news. Sales of new homes jumped 16 percent last month to the highest level since July 2008, the government reported Tuesday.

Home builder stocks rose for the second day in a row. PulteGroup climbed 25 cents, or 1.3 percent, to $19.30, after rising 5.7 percent the day before. The government reported Tuesday that sales of new homes jumped 16 percent last month.

"Some encouraging news for the bulls has been the housing data that has come out over the past couple of days," said Todd Salamone, director of research at Schaeffer's Investment Research.

The analyst said he remained "extremely bullish," on stocks in the medium and long-term, but cautioned that a pullback may lie ahead in coming days after the year's strong gains.

Discount retailers rose Wednesday. Dollar Tree jumped $4.31, or 11 percent, to $45.39 after reporting a 22 percent profit increase. Dollar General also rose $1.61, or 3.6 percent, to $46.56. Family Dollar Stores rose $1.39, or 2.5 percent, to $57.68.

The yield on the 10-year Treasury note rose two basis points to 1.90 percent.

Among other stocks making big moves;

? Priceline.com rose $17.42 to $695.91 after reporting that its net income jumped in the fourth quarter as bookings grew.

? First Solar plunged $4.32, or 13.8 percent, to $27.04 after the company posted disappointing sales for the fourth quarter and gave a weak early outlook for the year.

? Target fell 93 cents, or 1.5 percent, to $63.12 after the No. 2 discount chain's quarterly income fell 2 percent as it dealt with intense competition during the holiday shopping season.

? DreamWorks Animation fell 30 cents, or 1.8 percent, to $16.31 after posting a loss of $82.7 million. The company booked a write-off on its November release "Rise of the Guardians" and on an upcoming movie that needs to be reworked.

Drone drama as British military admits hundreds of lost UAVs

Over 400 drones ranging from palm-sized helicopters to a $16m combat-capable Reaper have been lost in action, blown up, or simply stopped working over the past five years, the British military has admitted. The Ministry of Defence has not put a final total on how much the UAV (unmanned aerial vehicle) deployment, which has taken place in Afghanistan and Iraq, has cost, but a new report on drone incidents has detailed the breadth of losses involved, the Guardian reports.

The single most expensive loss is probably that of a Reaper drone, which is capable of carrying both?reconnaissance?technology as well as Hellfire missiles for actively attacking remote targets. With a price tag of around ?10m ($16m) it is yet to be replaced; it?s unclear whether it was hostile destruction, pilot error, a fault with the UAV itself, or problems recovering the downed hardware ? all reasons for drone losses given by the MoD ? that was at fault.

Far more common, however, are smaller drones falling out of service. 412 of the UK army?s Desert Hawk 3 drones ? which resemble hobby airplanes ? have been destroyed or otherwise lost in the half-decade period, while the Black Hornet and Tarantula Hawk ?micro air vehicle?, both smaller models, have totalled 25 losses.

However, the MoD did admit to having lost nine of its Hermes 450 UAVs, costing ?1m ($1.6m) apiece, a total of half its overall fleet. Work in Afghanistan has been responsible for the vast majority of Hermes 450 losses; the drone is not intended for active attack use, but instead for surveillance and communications backup.

In its defense, the MoD points out that drones are often used for?reconnaissance?in areas where manned investigation would previously have been relied upon, reducing the potential risk to soliders and technicians. It also says that no deaths or injuries ? presumably of its own personnel ? have resulted from UAV crashes or losses. Meanwhile, the potential risks involved in recovering a downed drone in unfriendly territory can often lead to the hardware being abandoned.

Earlier this month, US law enforcements conducted what is believed to be the first drone manhunt?on US soil, searching for fugitive Christopher Dorner who was later killed outside of Los Angeles after a standoff with police. Last year, meanwhile, drone researchers revealed they had been working on nuclear-powered solutions for extended-deployment UAVs, which would be able to remain airborne for months at a time. However, the project apparently ended without prototypes being constructed.

Memo gives basis for drone strikes vs US citizens

WASHINGTON (AP) ? An unclassified Justice Department memo reveals that the Obama administration has had more lenient rules than publicly known for when drone attacks can be launched to kill U.S. citizens working abroad with terrorists.

The government does not need evidence that a specific attack is imminent, the newly disclosed Justice Department white paper says, only that the targeted suspect is involved in ongoing plotting against the United States.

"The threat posed by al-Qaida and its associated forces demands a broader concept of imminence in judging when a person continually planning terror attacks presents an imminent threat," the document says.

The undated document surfaced as Obama administration official John Brennan, who helped manage the drone program, heads to Capitol Hill on Thursday for his confirmation hearing to become CIA director. The hearing will take place as a growing number of senators are asking to see a still-classified Justice Department legal opinion that justifies the administration's position on drones and is binding on the entire executive branch.

White House press secretary Jay Carney declined Tuesday to discuss details, saying only that President Barack Obama takes seriously his responsibility to protect the United States and its citizens from al-Qaida terrorists.

"He also takes his responsibility in conducting the war against al-Qaida as authorized by Congress in a way that is fully consistent with our Constitution and all the applicable laws," Carney said.

Carney said care is taken to execute the strikes with precision and avoid the loss of innocent life.

"These strikes are legal, they are ethical and they are wise," Carney said.

Controversy over U.S. policy for drone attacks mushroomed after a September 2011 drone strike in Yemen killed Anwar al-Awlaki and Samir Khan, both U.S. citizens.

In a speech last March, Attorney General Eric Holder said that in assessing when a targeted killing against a U.S. citizen is legal, the government must determine after careful review that a citizen poses an imminent threat of violent attack against the U.S. Brennan had made a similar speech justifying the strikes as self-defense against imminent threat of attack.

Asked Tuesday about the definition of "imminent threat" at a news conference on an unrelated topic, Holder said that "so many of these things are fact-based" and that "you can't examine the terms without reference to the facts." He said such details can be discussed only in a classified setting.

"Our primary concern is to keep the American people safe, but do so in a way that is consistent with our law and our values," Holder said.

The Justice memo says that delaying action against U.S. citizens who are linked to al-Qaida would create an unacceptably high risk because some al-Qaida leaders are continually plotting attacks on the U.S. and the U.S. may not always be aware of each specific plot as they develop.

This week, a bipartisan group of 11 senators asked President Barack Obama for all legal opinions underlying the authority to kill American citizens. The newly disclosed Justice Department document, first reported by NBC News on Monday night, represents an unclassified summary of those legal opinions and may have been prepared to deflect demands to see the actual classified legal opinions.

Sen. Dianne Feinstein, D-Calif., chairman of the Senate Intelligence Committee, said Tuesday that her panel received the unclassified document, and others, from the administration in June 2012 on a confidential basis. She said this document, coupled with other documents and closed briefings, "has allowed the Intelligence Committee to conduct appropriate and probing oversight into the use of lethal force."

Noting that she had been calling for public release of the legal basis for using lethal force, particularly against U.S. citizens, for more than a year, Feinstein said with disclosure of the white paper "the American people can review and judge the legality of these operations."

She added, however, that the committee continues to seek the actual legal opinions that provide details not contained in the white paper.

The Justice memo does require that capture of a terrorist suspect not be feasible and that any such lethal operation by the United States targeting a person comply with fundamental law-of-war principles.

"A decision maker determining whether an al-Qaida operational leader presents an imminent threat of violent attack against the United States must take into account that certain members of Al-Qaida ... are continually plotting attacks against the United States" and that "al-Qaida would engage in such attacks regularly to the extent it were able to do so," says the document.

The document also says that a decision maker must take into account that "the U.S. government may not be aware of all al-Qaida plots as they are developing and thus cannot be confident that none is about to occur; and that ... the nation may have a limited window of opportunity within which to strike in a manner that both has a high likelihood of success and reduces the probability of American casualties."

With this understanding, the document added, a high-level official could conclude, for example, that an individual poses an imminent threat of violent attack against the United States where he is an operational leader of al-Qaida or an associated force and is personally and continually involved in planning terrorist attacks against the United States.

The American Civil Liberties Union said the document is "profoundly disturbing."

"It's hard to believe that it was produced in a democracy built on a system of checks and balances," the ACLU said.

The document says that the use of lethal force would not violate the Fourth Amendment of the Constitution when a targeted person is an operational leader of an enemy force and an informed, high-level government official has determined that he poses an imminent threat of violent attack against the U.S.

The document said the courts have no role to play in the matter.

"Under the circumstances described in this paper, there exists no appropriate judicial forum to evaluate these constitutional considerations. It is well established that 'matters intimately related to foreign policy, and national security are rarely proper subjects for judicial intervention,'" the document said.

The Hot Brown (Louisville Hot Brown Sandwich) - Tv Food and Drink

This month?s Burwell General Store Recipe Swap comes from the Maison La Fitte in Palm Beach. ?Remember when we went to Maison La Fitte after that day of sun-dappled Palm Beach antiquing? You found that kicky flapper?s hat and I picked up that wagon wheel in the heart of the shopping district? ?Then we sat down in the picturesque courtyard and ate a pound of chicken meat cooked in a pint of heavy cream?

Well, the very best thing about the Burwell General Store Recipe Swap is that the recipe selected by its moderator is merely a jumping off point for the rest of us. ?So I scanned the rundown on Stuffed French Pancakes until I found something that greased my flag pole, in this case called ?Mornay sauce.?

Mornay sauce is a B?chamel sauce (roux of butter and flour cooked in cream or milk) combined with shredded or grated cheese, in this case about a 1/2 cup of Pecorino Romano. ?Once well-simmered, I seasoned the sauce with salt and pepper, poured it over two slices of Texas Toast (your local grocery story may call it simply ?French Toast?) topped with turkey and ham, tossed in some sliced tomatoes and a little more Pecorino Romano, broiled it until it was bubbly brown, and baptized the results with some parsley and smoked paprika. ?The finished product is what?s known as the ?Hot Brown,? a signature sandwich invented by Chef Fred K. Schmidt at the Brown Hotel in Louisville, Kentucky in 1926. ?The ?official? recipe for the Hot Brown follows below.



The Hot Brown? From The Brown Hotel ? Louisville, Kentucky
(Makes Two Hot Browns):

  • 2 oz. Butter
  • 2 oz. AP Flour
  • 16 oz. Heavy Cream
  • 1/2 Cup Pecorino Romano Cheese, Plus 1 Tablespoon for Garnish
  • Salt & Pepper to Taste
  • 14 oz. Sliced Roasted Turkey Breast
  • 2 Slices of Texas Toast (Crust Trimmed)
  • 4 slices of Crispy Bacon
  • 2 Roma Tomatoes, Sliced in Half
  • Paprika
  • Parsley

In a two-quart saucepan, melt butter and slowly whisk in flour until combined and forms a thick paste (roux). Continue to cook roux for two minutes over medium-low heat, stirring frequently. Whisk heavy cream into the roux and cook over medium heat until the cream begins to simmer, about 2-3 minutes. Remove sauce from heat and slowly whisk in Pecorino Romano cheese until the Mornay sauce is smooth. Add salt and pepper to taste.

For each Hot Brown, place one slice of Texas toast in an oven safe dish and cover with 7 ounces of turkey. Take the two halves of Roma tomato and set them alongside the base of turkey and toast. Next, pour one half of the Mornay sauce to completely cover the dish. Sprinkle with additional Pecorino Romano cheese. Place entire dish under a broiler until cheese begins to brown and bubble. Remove from broiler, cross two pieces of crispy bacon on top, sprinkle with paprika and parsley, and serve immediately.

HP to close site in Germany, to cut 850 jobs

(Reuters) - Computer maker Hewlett-Packard Co said on Friday it is planning to close a site in Germany by the end of October as part of its multi-year restructuring plan.

HP said it was closing its site in Ruesselsheim, Germany, southwest of Frankfurt, and that around 850 jobs would be cut. The remaining 250 employees may be able to transfer to HP partners or clients.

The restructuring of its enterprise services business will not affect HP's other major sites in Germany, the company said, adding that it would continue to employ about 10,000 people in Europe's largest economy.

HP said last year that it was planning to lay off 29,000 employees over two years as it tries to return to growth.

The company, which employs more than 300,000 people globally, began a multi-year restructuring last year aimed at focusing the sprawling company on services targeted at corporations.

HP shares were up 16 cents at $16.67 in morning trading.

Apple is biggest US phone seller for first time

The launch of the iPhone 5 and the declining popularity of non-smartphones have made Apple the biggest seller of phones in the U.S. for the first time, research firm Strategy Analytics said Friday.

The firm estimates that Apple shipped 17.7 million iPhones of all kinds to U.S. buyers in the October to December period, meaning it accounted for one in three new phones.

Samsung Electronics of Korea was close behind, shipping 16.8 million phones, including non-smart ones. Samsung has been the largest seller of phones to the U.S. market since 2008, Strategy Analytics said.

Worldwide, Samsung is still the biggest phone vendor with 23 percent of the market, according to another research firm, IDC. Apple is No. 3, with 9.9 percent of the market. Inbetween sits Nokia with 17.9 percent.

Samsung beats Apple even when only smartphones are considered. It shipped 63.7 million units worldwide versus Apple's 47.8 million.

IPhones are more expensive than most Samsung smartphones. So, they're well within reach for U.S. buyers, but not for buyers in the developing world, where cheaper phones running Google's Android operating system dominate.

In the U.S., iPhone sales are usually very strong in the first few months after a new model is released. They then taper off. That means Samsung could regain the smartphone crown as early as this quarter. (Apple's lead was also enhanced because the iPhone 5 launch was done at the start of the fourth quarter to help?maximize sales.)

The NPD Group, another research firm, on Friday said the iPhone 5 was the single most popular phone in the U.S. in the holiday quarter. The Samsung Galaxy S III was No. 2, followed by the older iPhone models, the 4S and 4.?
